Do I need a lawyer?
There is really only one way to find the answer to this question. Ask a lawyer. Too many times a client will ask the wrong person if they should hire or seek the advice of a lawyer. An insurance adjuster will not likely advise the injured to hire a lawyer. A business competitor or an opposing party to a contract will not likely advise you to hire an attorney. What do I do if our marriage is not working and I want a divorce?
- Secure proper legal representation
- Follow your attorney's advice.
- Gather your financial records, including tax returns, notes, deeds, title certificates, and other legal papers, and deliver them to your attorney so that he may properly utilize discovery procedures.
- Do not involve yourself in domestic disputes.
- Insulate the children from the marital conflict. Do not talk badly about the other party in front of a child.
- Attempt to be civil and do not escalate the issues in your divorce action.
- Keep a diary of events.
- Advise your attorney and/or police if there is any type of abuse
How long do I have to file a lawsuit?
This is not a simple question. The time to file a lawsuit changes dependent on what type of matter you have. Lawsuits and their timeframes are governed by a Statute of Limitations. A Statute of Limitations can be a term of months, days, or years. A Statute of Limitations varies from type of matter and/or court. A Statute of Limitations can also be delayed for many reasons.
